Terms & Conditions:
The Store, and all content available on the Store, is provided on an “as-is” basis without warranties or conditions of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. All goods and services purchased via the Store are provided on an “as-is” basis unless otherwise noted in the packaging included with the goods and services.
You acknowledge, by your use of this Store, that your use of this Store is at your sole risk, that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of this Store, and that neither 3Doodler nor any of their partners shall be liable for any damages of any kind related to your use of this Store.
All rights, title, and interest in and to the 3Doodler goods and services provided here are and will remain the exclusive property of 3Doodler and its licensors. They are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in the Terms & Conditions gives you a right to use the 3Doodler name or any of the 3Doodler trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding 3Doodler, or 3Doodler’s services, is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
Additionally, when you order in our store, we collect and store your email address. From that point forward, your email address may used by 3Doodler and its partners to send you product updates. Subscribers can Opt Out by clicking the “Unsubscribe” link which is automatically added to the bottom of each promotion email or by contacting us at [email protected].
3Doodler is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and occasionally linking to amazon.com.
Pricing and Availability:
All goods and services offered via the Store are subject to availability. Prices are subject to change without notice at any time.
3Doodler reserves the right to cancel or refuse any order for any reason at any time, including after an order has been submitted, whether or not the order has been confirmed. We may attempt to contact you if all or a portion of your order is canceled, or if additional information is needed to complete and accept your order.
Depending on the order, 3Doodler calculates and charges sales or any other applicable taxes. Any taxes charged will be indicated during the checkout process. 3Doodler does not have the ability to honor tax-exempt entities at the time of order (other than on our EDU store, for which approval is granted on an ad-hoc basis – if you are an EDU buyer and require more information, please email us at [email protected]).
Resale and Risk of Loss:
Purchases made via the Store are intended for end users only, and are not authorized for resale. Title and risk of loss for all products purchased from the Store pass to the purchaser at the time of delivery by 3Doodler (or its representatives or agents) to the freight carrier.
At this time we offer only one method of shipment to certain locations; additional methods will be offered to Customers at checkout if available at that given time.
3Doodler is not responsible for lost or stolen packages or packages delayed by postal services, customs border protection agencies, or for packages that have been denied or returned at any stage during delivery. In the event that a package is lost or stolen or you have given the wrong address, 3Doodler is not liable for the contents of the package and are not obligated to give you a refund. Re-shipping and re-delivery fees are the responsibility of Customer.
Please note that you (the customer) will be responsible for any customs fees, duties, taxes, or any related agency fees imposed on shipments sent via standard (registered post) shipping methods. These payments, if charged, must be settled by you upon the arrival of your shipment. Unfortunately there is currently no method for 3Doodler to charge for and prepay these fees on your behalf. Only orders which are ordered via our EDU store will be shipped with duties paid in advance (DDP).
Please also note that tax exempt entities are exempt from sales taxes, but are not generally exempt from import duties and related fees.
All EDU Bundle shipments are sent DDP (save for countries where this is administratively problematic, in which case we will process the order manually on an ad hoc basis – such countries include Brazil, Colombia, Ecuador, Argentina, Peru, and most African countries).
3Doodler does not warrant that the product descriptions or other content found on the website is complete or error-free at all times. If you receive a product from 3Doodler that is not as described, your sole remedy is to return it in an unused condition in accordance with designated conditions below on Returns.
The price of an item cannot be confirmed until you place your order. Whilst every effort is made to ensure accurate pricing, some items may be mispriced; if the correct price for an item is actually higher than your ordered price, the order may be held pending for further details before shipping or may be cancelled upon which you shall be notified of such cancellation.
Order Placement and Import:
By placing an order via 3Doodler’s sites, you accept all responsibility for ensuring that your purchase can be imported in accordance with the laws of the country to which you have requested delivery to be made to and you agree to comply with all laws and regulations of the country in which the goods are received. Customs clearance procedures may mandate the opening and inspection of cross-border deliveries.
Payment for Purchases:
Payment for the ordered items is due at the time the order is acknowledged. 3Doodler offers, at the point of checkout, various payment methods such as credit cards and other popular payment methods for customers to make payment for their ordered items. You will accept responsibility to pay all costs and fees in connection with your ordered items in relation to the use of the payment method of your choice . In the event of any unauthorized transactions made to your payment account by a third party, you will be responsible for the amounts billed. Where payment for purchase(s) on our website is not settled to 3Doodler, you will agree to pay all amounts due to 3Doodler upon demand.
Completing an order on 3Doodler’s sites, or making a payment to 3Doodler represents your offer to us to make a purchase of the ordered items. 3Doodler will email you acknowledgement of your offer to confirm your order details. The offer of your purchase will be accepted by 3Doodler when the product is dispatched and confirmation of this is e-mailed to you, as represented by a dispatch email. In the event your order includes multiple items, any item(s) included in your offer of purchase that are not dispatched and not included in the dispatch email, will not be included in the acceptance of your offer of purchase for those affected items.
Where your order basket includes “in stock” items along with “pre-order” items, “in stock” items may be shipped, at the sole discretion of 3Doodler, prior to the dispatch availability of the “pre-order” items.
We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item. We aim to keep the process as simple as possible and these terms do not affect your statutory rights.
We will try to attend to all returns as soon as practically possible.
Please note that product returns cannot be accepted in person at our office address.
If you are unhappy with an item when you receive it or if you simply change your mind please return it to us within 7 days, with the dispatch note, having taken reasonable care of it and with packaging and all components, and we will refund you the price you paid for that product.
We will make the refund directly to the credit/charge card/PayPal account used to place the original order within 30 days or earlier once we have inspected the returned item.
Any Refund approved shall be minus Refund Deductibles (comprising of a combination of, but not limited to, shipping costs incurred either by 3Doodler or you, restocking fees, and administration costs). Details of Refund Deductibles are determined at the discretion of 3Doodler, and shall be made available along with your refund eligibility information at the time of processing your refund.
NOTE: This general returns policy shall not to apply to:
(i) any plastic filament sold on the Store where the packaging of that plastic filament has been opened; or
(ii) any 3Doodler pens which have been used to extrude any plastic.
Faulty Damaged Products
We try to select and package the products as well as possible to ensure they arrive in good condition. However, if a product arrives damaged or with defects, or is not what you ordered (due to an error or omission on our part), we will replace it free of charge or provide a full refund as appropriate, if you return the product to us within 30 days of receipt.
In these circumstances, or where your product is deemed to be defective under our Limited Warranty, we will also pay you the cost of the return postage. Otherwise, you are responsible for the costs of shipping the product back to 3Doodler.
Please obtain a proof of posting certificate from your post office to enable us to process the refund for your return postage costs.
This does not affect your statutory rights.
Process for Returning Products:
Please email [email protected] to inform us of your wish to return products. Please ensure you quote your order number.
We will allocate a Returns Code, which must be included on the label of the package in order to process your return.
We may also advise you how to send the item back to us.
You will be responsible for the returned products until they reach us.
European Distance Selling Regulations (DSRs):
By law, consumers in the European Union have the right to cancel a contract for the purchase of an item within 14 days of the day after receipt of the order. In some European countries it is in fact a shorter period, but a 14-day returns period will be required when changes to the DSRs come into effect in 2014.
If you wish to cancel your order under the DSRs we ask you to please notify our Customer Service team quoting your name and order number by email at [email protected], and stating that this is a return under the DSRs.
We will then arrange for you to be refunded accordingly to this returns policy (see above).
3Doodler reserves the right to investigate and prosecute violations of any part of these Sales Terms to the fullest extent of the law; in doing so, 3Doodler may involve and cooperate with law enforcement authorities in prosecuting users. You acknowledge that 3Doodler has no obligation to monitor your access to or use of 3Doodler’s sites, but reserves the right to do so for purpose of operating 3Doodler’s sites, to ensure your compliance with these Sales Terms or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body.
3Doodler products are supplied with the Product Warranty (and any inclusions or exemptions as specified therein).
Any dispute, or claim relating in any way to your visit to our website or to products or services sold or distributed by 3Doodler will be subject to confidential binding arbitration in Hong Kong, rather than in court, except that you may submit for claims in small claims court if your claims qualify. Arbitration will not include any judge or jury, and court review of an arbitration ward is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Sales Terms as a court would. Arbitration shall be conducted, and documents presented, in English; or be accompanied by an English translation of the documents. The Arbitration award will state the reason(s) upon which the award is based.
You agree that the laws of the Hong Kong will govern these Sales Terms and any dispute of any sort that might arise between you and 3Doodler or its affiliates as a result of or under these Sales Terms.
You agree that these Sales Terms and all agreements and information incorporated herein may be automatically assigned by 3Doodler, in its sole discretion, to a third party. You may not assign your obligations to another party.
